摘要
我国新修订《体育法》增设体育仲裁,构建起中国特色体育仲裁制度,为体育纠纷提供新的纠纷解决途径,对仲裁独立性与一裁终局等仲裁基础原则的确认、扩张性的体育仲裁意思自治原则和体育仲裁特别程序方面对我国的仲裁制度做出了创新和有益补充.通过与日本体育仲裁制度的对比分析,我国体育仲裁制度可进一步发挥仲裁独立性、根据需求调整扩大体育仲裁范围、加强体育仲裁与行业内部纠纷解决机制衔接、适当公开体育仲裁裁决,更加有效贯彻"及时、公正解决体育纠纷,保护当事人合法权益"这一立法宗旨,促进我国体育仲裁的发展.
Abstract
China's newly revised Sports Law set up sport arbitration regime with Chinese characteristics,provides a new way to resolve sports disputes,makes innovative and beneficial supplements to China's arbitration system in terms of the adoption of the principles of arbitration independence and the finality of arbitration,the expanded principle of autonomy of will of sports ar-bitration and the special procedures of sports arbitration.Through the analysis with the Japanese sports arbitration system,China's sports arbitration can further present the independence of arbitration,adjust the scope of sports arbitration according to practice,strengthen the connection between sports arbitration and the internal dispute resolution mechanism,and properly pub-lish sports arbitration award,so as to more timely and fair settlement of sports disputes,to protect the rights and interests of the parties and to promote the development of sports arbitration in China.
