摘要
运用文献资料、逻辑分析、案例分析等方法,探讨数字时代运动员数据权利保护价值、困境,并提出保护策略.价值:维护个人隐私,保障权利归属,提升数据经济价值.困境:数据隐私权保护不到位,个人信息自决权保护欠缺,数据财产权保护力度不足.保护策略:规范数据采集获取行径,遵循数据隐私权保护原则;维护数据占有主体权益,落实个人信息自决权保护;建立健全数据产权系统,加强数据财产权保护力度.
Abstract
By using the methods of literature review,logic analysis and case analysis,this paper discussed the value and dilemma of athletes'data rights protection in the digital age,and put forward protection strategies.Value:It protects personal privacy,ensures ownership of rights,and enhances the economic value of data.Dilemma:The protection of data privacy rights is not in place,the protection of personal information self-determination is insufficient,and the protection of data property rights is insufficient.Protection strategy:We should standardize data acquisition practices to follow the principle of data privacy protection;safeguard the rights and interests of data possessors to implement the right to self-determination protection of personal information;and establish a sound data property rights system and strengthen the protection of data property rights.
