Practice and Improvement of Internal Dispute Resolution System of Individual Sports Association
Literature and logical analysis were used to examine the internal dispute resolution systems of individual sports associations and to seek for solutions in order to provide references for promoting good laws and good governance of the associations.It was shown that the dispute resolution system of individual sports association paid insufficient attention to the individual risk of multiple participants in sports events,and lacked the overall perspective of risk resolution.Most individual sports associations lacked actual executive agencies for dispute resolution,and only a few associations had established relatively systematic internal dispute resolution systems and specialized agencies.The control and handling authority of disputes and conflicts in sports affairs were vaguely directed to the associations,and there was no clear channel and procedure for parties to appeal,which had not yet met the needs of governing sports according to law.Although the normative system formulated by the individual sports association involved the content of dispute resolution,the relevant system was limited in weakening function in resolving risks,and the supply of internal dispute resolution system is obviously insufficient.According to the characteristics of sports events of individual sports associations and the actual needs of risk resolution,it was urgent to focus on risk prevention led by multiple participants in project affairs and establish an overall perspective of risk resolution.According to the guiding spirit of the new Law of PRC on Physical Culture and Sports encouraging the establishment of dispute resolution mechanism,the internal dispute resolution institutions of individual sports associations should be established,the current normative system of individual sports associations should be built,the internal dispute resolution system of the associations in accordance with the regulatory requirements of the sports arbitration system should be established,the applicable scope,procedure,deadline and other specific operational systems of the association's dispute resolution on the basis of repeated arguments should be clarified,the dispute resolution system should be incorporated into the association's charter so as to confirm rights,and strive to normatively resolve and deal with disputes in sports events.
