Research on Binding Corporate Rules for Cross-border Data Flows
The binding corporate rules established by the EU General Data Protection Regulation are one of the appropriate safeguards in the EU rules on the cross-border transfer of personal data,and they have significant advantages as a compliance tool for cross-border data flows.In China's Personal Information Protection Law passed in 2021,only standard contract clauses were introduced by reference,and binding corporate rules have not been explicitly introduced into Chinese laws.In order to facilitate Chinese enterprises'endeavors to"go global",China should introduce binding corporate rules.Therefore,China should clarify the upper legal basis of binding corporate rules,and reasonably learn from other countries'practical experience to create binding corporate rules with Chinese characteristics.
