摘要
优化营商环境是我国激活市场活力、提升政府服务水平的关键举措.行政法可以发挥其稳定、公正及公平功能,满足市场主体对良好营商环境的需求.但当前在以行政法优化营商环境方面存在信赖利益保障待加强、"放管服"改革待深化及行政执法不规范的问题.通过加强政府信用建设、深化"放管服"改革及以"以人为中心"的理念规范行政执法行为,有助于从行政法视角优化营商环境.
Abstract
Optimizing the business environment is a key measure for China to activate the vitality of the market and improve the level of government services.Administrative law can exert its functions of stability,justice,and fairness to meet the needs of market entities for a favorable business environment.However,at present,in terms of optimizing the business environment with administrative law,there are problems such as the necessity of strengthening the protection of reliance interests,the need to deepen the reform of"streamlining adminis-tration,delegating powers,combining regulation and management,and improving services",and the lack of standardization in administra-tive law enforcement.By strengthening the construction of government credit,deepening the reform of"streamlining administration,delega-ting powers,combining regulation and management,and improving services"and standardizing administrative law enforcement behaviors with the concept of"people-centered",it is helpful to optimize the business environment from the perspective of administrative law.
