The Infringement Determination and Legal Regulation of Internet Splash Ads
With the rapid growth of China's Internet advertising market,splash ads have become an important income source for Internet media platforms.However,excessive splash ads not only affect the user experience,but also cause more negative phenomena.This paper focuses on the infringement of Internet splash ads,defines the concept of Internet splash ads,and analyzes the users'rights and in-terests that may be infringed.On this basis,this paper proposes the criteria for judging the infringement of Internet splash ads,including the intention or negligence of the operator,the infringement of the user's subjective will,the prominence of the advertising closure mark,and the existence of the damage fact.Finally,this paper analyzes the dilemma of legal regulation of Internet splash ads and explores the path of legal regulation,including regulating online click contracts,giving play to the self-regulatory role of industry associations,and improving the public interest litigation mechanism.These measures aim to protect the rights and interests of consumers and maintain the order of the Internet market.
