Legal Status of the 12345 Platform——An Organizational Law Observation of the Digital Rule of Law Government
The 12345 platform has given rise to a new type of power—digital power,coming out of the need for national governance,based on cooperative administration and carried by digital technology.The expansion of digital power of 12345 platform brings difficulties in administrative organization law:digital power changes the traditional power structure,thus challenging the principle of statutory authority of the organization law:digital power blurs the boundaries of traditional power,thus bringing administrative legitimacy problems;digital power causes decentralization,thus the blurring the subject of the attribution mechanism.As a new mode of operation for administrative organizations,the 12345 platform is an overall mode of administrative tasks-oriented operation,forming a dynamic digital ecosystem,and representing a new mode of cooperation based on new public management and a gradual shift towards the paradigm of network governance.As a product of digital government construction,the 12345 platform should be regulated by administrative organization law.In the context of digital rule of law government construction,the overall government reform should be oriented to scientifically adjust the administrative organization law system,digital literacy,supervision mechanism,technology and legal means should be employed to address the administrative legitimacy challenges,and there should be a shift from procurement thinking to rule-making thinking to design responsible AI in accordance with the law.
