A Discussion on the Legal Personality Identification of ChatGPT and the Nature of its Generated Content
With the widespread use of Chat GPT,the discussion of legal issues on artificial intelligence has once again become the focus of public opinion.According to the characteristics of ChatGPT system and human interaction to generate corresponding text content,it is controversial whether ChatGPT generated content is protected by the Copyright Law.To explore this issue,there are two indispensable prerequisites,that is,whether ChatGPT has legal personality and whether its generated content can be recognized as a work.This paper believes that ChatGPT does not yet have the qualification of a legal entity.When the content generated by ChatGPT is recognized as a work,it should be clearly defined that ChatGPT users are the copyright subjects of the generated content,and the regulation of the generated content should be implemented by strengthening the supervision of ChatGPT copyright subjects.In this way,we can accelerate the process of promoting the rule of law in artificial intelligence.
