Modernization of Criminal Justice:Functional Reflection and Development of Evidence Standards
Theoretically,the core connotation of the standard of evidence refers to the collection of evidence that should be collected to prove a certain type of crime.In practice,the standard of evi-dence is given a specific management function by the political and legal decision-making levels to re-alize the double improvement of trial quality and efficiency.As a management tool,the standard of evidence helps to improve judicial efficiency,but it is difficult to realize the core goal of accurately determining facts.The reason is that,the construction of evidence standards from the previous deci-sion documents of the empirical summary,and thus there are fixed types of evidence,evidence at-tributes of narrow,unidirectional scope of evidence,the standard constitutive elements,such as in-herent shortcomings,which leads to evidence standards difficult to achieve its preset goals.The standard of evidence has the characteristics of unity,openness and standardization,and has the po-tential to achieve the goal of accurately determining the facts.We should be the best explanation of reasoning as the basic concept of perfecting the evidence standard,in the pre-trial stage,it should emphasize the comprehensive evidence collection and methodology;in the trial stage,it should em-phasize the dynamics and consistency of the evidence review.
