摘要
随着互联网时代的到来与人工智能技术的发展,算法应用变得更加广泛和普遍,算法决策也随之兴起.基于上述背景,研究和分析互联网电商平台算法规制成为一项必要的时代性课题.因此,本文一是对互联网电商平台的算法规制进行必要性分析,明确算法在法律和现实生活中的地位;二是在必要性证成后,将对目前互联网电商平台存在的立法困境进行总结和归纳;三是将针对这些立法困境,提出现阶段可行的立法路径.
Abstract
With the arrival of the the Internet Ages and artificial intelligence technology developing,the algorithm is widely used and the algorithm for decisions emerged correspondingly.In light of that,study of the algorithm regula-tion used on e-commerce platform becomes an urgent project.Therefore,this paper delves into it in three as-pects.First,it asserts the role of algorithm in law and the real world after analyzing the need for the algorithm regu-lation on the internet and e-commerce platform;Second,it summarizes the plights of legislation in e-commerce;Third,it puts forward some feasible paths for legislation.
