数据知识产权质押机制及实践进路

在大数据时代背景下,科技与创新型企业以自有数据资产之上知识产权质押获得融资成为一种创新的融资方式,得到金融类机构和企业的共同认可.由于数据资产及其形成的知识产权具有无形、可复制的特性,其质押标的受到如何确权、监管和风险控制等方面的制约,质押流程又缺少实体及程序法律规范,实际操作中没有实现高效、普惠与广覆盖.为促进数据要素在金融领域赋能新质生产力发展,本文从目前数据质押的现状梳理开始,分析了存在的问题;在当前的社会管理、经济与法律框架下,提出了针对性的解决方案;最后从满足现行质押的法律框架和实际可操作性要求出发,提出了确权作为前提、信息化及密码技术为主要实现手段的数据知识产权质押机制实现方法.
Data Intellectual Property Pledge Mechanisms and Practical Approaches
In the era of big data,it has become an innovative financing method for science and innovative en-terprises to obtain financing by pledging intellectual property rights on top of their own data assets,which has been recognized by financial institutions and enterprises as an innovative financing method.Due to the intangible and replicable nature of data assets and the resulting intellectual property,the pledged objects are subject to con-straints in terms of how to confirm ownership,supervision,and risk control.The pledge process also lacks physical and procedural legal norms,and in actual operation,it has not achieved high efficiency,inclusiveness,and wide coverage.In order to promote the development of data elements in the financial field to empower the new quality productivity,this paper analyzes the existing problems by combing the current situation of data pledging;puts for-ward targeted solutions under the current social management,economic and legal framework;and finally,from the perspective of meeting the requirements of the current legal framework of pledging and practical operability,this paper puts forward a method to realize data intellectual property pledging mechanism with the prerequisite of con-firming the right,and the informatization and cryptography technology as the main means of realization.
