生态文明建设背景下天然林保护法律制度体系的构建

天然林保护立法是天然林保护政策法律化的客观要求，是完善天然林保护法律制度体系的应然之选，更是促进生态文明建设的关键举措。以制定专门的《天然林保护条例》为研究对象，运用政策解读、法律分析和实证研究的方法，分析《天然林保护条例》的基本原则和制度体系。结果表明:《天然林保护条例》应坚持全面保护、科学修复、严格监管、公众参与、可持续发展的基本原则，以凸显天然林生态系统的多重价值，引领整部立法的结构布局和制度体系;《天然林保护条例》的制度须与基本原则相呼应、与既有政策相协调，应包括保护性制度、管制性制度、保障性制度、责任性制度四类，从而构成具有规范性、约束性和可操作性的天然林保护法律制度体系。
Construction of Legal System of Natural Forest Protection Under the Background of Ecological Civilization Construction
The legislation of natural forest protection is the objective requirement of the legalization of natural forest protection policy,the necessary choice to improve the legal system of natural forest protection,and the key measure to promote the construction of ecological civilization.Taking the formulation of special'Regulations on the Protection of Natural Forests'as the research object,this paper analyzes the basic principles and system of Regula-tions on the Protection of Natural Forests employing policy interpretation,legal analysis and empirical research.The results show that the'Regulations on the Protection of Natural Forests'should adhere to the basic principles of com-prehensive protection,scientific restoration,strict supervision,public participation and sustainable development,to highlight the multiple values of natural forest ecosystems and guide the structural layout and institutional system of the whole legislation.The system of'Regulations on the Protection of Natural Forests'should echo the basic princi-ples and coordinate with the existing policies,and should include 4 categories:protection system,control system,guarantee system and responsibility system,to form a normative,binding and operational legal system for the pro-tection of natural forests.
