An Analysisof Identification Rules for Membershipof Rural Collective Economic Organizations in the Context of Chinese Path to Modernization
The identification,loss,and retention of rights following the loss of membership in rural collective economic organizationsexert significant impact on the interests of rural residents.Scientific institutional design is essential for guiding good rural governance,promoting common prosperity,and achievingthe Chinese path to Modernization.The"Law on Rural Collective Economic Organization(Second Review Draft)"(hereinafter referred to as the"Draft")de-fines the membership of rural collective economic organizations based on household registration.However,it should not mandate that members'basic livelihood guaranteebe provided solely by collectively owned land or other assets,nor should a stable relationship of rights and obligations between the two be a prerequisite for defining membership.Re-garding the loss of membership,a classification method based on"household registration+financial burden of wages and benefits"can be employed to exclude groups such as civil servants and public institution staff from organizational membership.For members who are temporarily absent due to reasons such as employment,business,military service,or education,due to reasons such as working,doing business,serving in the military,or studying,the retention period for core property rights like land contract rights and homestead use right should not be uniformly defined but determined reasonably according to the nature of the rights.The"Draft"can protect the legitimate rights and interests of rural res-idents,enhance their enthusiasm for self-management,and promote the modernization of rural governance systems and capabilities by refining and improving the relevant provisions related to membership.
