In the digital age,the Internet hospital comes into being on the basis of algorithm technology,and it bears the responsibility of protecting private rights and interests in the collection,storage,mining and application of patients'personal information.The principle of proportion,a legal principle to ensure the balance of interests,is of great significance in regulating the establishment of Internet hospital diagnosis and treatment service agreements,balancing the interests of Internet hospitals and patients'personal information rights and interests,and in improving the multiple protection mechanism of patients'personal information rights and interests.At present,there exist problems in patients'personal information right and interest protection in Internet hospitals such as maliciously caused insurance difficulties,targeted commercial advertisements,and significantly increased safety risks.Therefore,the principle of proportionality should be followed,and the legitimacy,appropriateness,necessity,and balance should be emphasized by in information reviewing so that the interests of Internet hospitals and patients'personal information is balanced by rewriting the consent rules,establishing data supervision platforms,and by introducing reasonable judgment mechanisms.
