On the Legal Governance and Institutional Construction of Smart City Data
In the process of smart city construction and development,the legal governance of smart city data constitutes a problem that should be taken seriously.According to the"rule of law theory of data governance",as far as the legal governance of smart city data is concerned,it should not be too obsessed with technical governance,but should take legal governance as a means to deeply combine the elements of"rule of rules"and"rule of technology",give full play to the centralized management function of the National Data Bureau,and strengthen the data management function of smart city management agencies around the country.We need construct a new legal governance model for smart city data that contains humanistic factors,promote the reasonable opening and sharing of public data(excluding personal data),and finally establish a legal mechanism for data governance that meets the requirements of data ethics.
