Deepening the Reform of the Trial-Centered Criminal Procedure System:Focusing on Further Amendment to The Criminal Procedure Law
The reform of the trial-centered criminal procedure system is a major initiative deployed by the CPC Central Committee to advance the modernization of criminal justice.Since the implementation of the reform,notable progress has been made in areas such as litigation philosophy,judicial system and court proceedings.However,following the 2018 amendment to The Criminal Procedure Law,challenges such as the narrow scope of reform,insufficient institutional integration,and the failure to incorporate legislative advancements have become increasingly apparent.The further revision of The Criminal Procedure Law is an important opportunity to deepen the reform and to overcome these challenges,which should consolidate achievements of the previous reform and guide the future progress.Re-amendments to The Criminal Procedure Law may consider promoting the centrality of trial procedures through the establishment of principles in the general provisions,the re-establishment of regulations in the sub-programmes,and the addition of chapters on public prosecutions;promoting the centrality of first-instance procedures through the adjustment of first-instance procedures,the adjustment of supporting systems,and the adjustment of the functions of the second-instance procedures;and promoting the substantiation of trial procedures through the reform of the system of people's assessors,the optimization of the system of pre-trial conferences,and the standardization of court trial procedures.
