The Systematic Construction of the Basic Principles of Supervision Law
The core value of the Supervision Law is to promote a systematic advancement in China's anti-corruption governance,including ideological updates,mechanism construction,and legal safeguards.It strikes a balance between the"expansion of power"and"limitation of power".As legislation rooted in practical experience,the fundamental principles of the Supervision Law form the basis of the legal principles,guidelines,and essential spirit of supervisory law,playing a significant role in both the theoretical construction and practical operation of disciplinary and supervisory law.At present,China has yet to be a consensus on the basic principles of the Supervision Law.In light of China's supervision legislation and current theoretical context,the establishment of the fundamental principles of the Supervision Law must conform to formal standards of legality,fundamental nature,and specificity,and must be grounded in the core values and fundamental contradictions of the Supervision Law.Based on this,those fundamental principles should be established for the Supervision Law:adherence to the Party's leadership,supervision according to law,protection of the rights and interests of the parties,comprehensive supervision coverage,the independent exercise of supervisory powers according to law,and mutual cooperation and checks and balances.These fundamental principles should be clarified as soon as possible through legislative amendments in the general provisions of the law,while accelerating the codification of the Supervision Law,building a foundational theoretical system for disciplinary and supervisory law,formulating discretionary standards for disciplinary supervision,incorporating proactive governance concepts,and achieving a"prevention-punishment coordination"model of anti-corruption governance.
