As a new administrative mode,public data openness is regarded as an important strategy of digital country,which is of great significance to economic and social development and government governance ability.A comprehensive review of the changes in the constitutional basis of China's public data opening shows that the constitutional basis for the right to know and the right to supervision is outdated,which should be effectively related to the right to development,especially the right to economic development,and the constitutional basis of the new development concept.In terms of constitutional tasks,open public data,as a production factor and distribution mode,has established the constitutional positioning of the system on the two approaches of factor structure reform and resource integration and distribution.In the future,we should seriously treat the constitutional value of public data openness,ensure the fair access,development and utilization of public data by the general public and other market subjects,pay attention to the subjective value of the people in the implementation of the system,connect with the public and always strive to realize the people's nature of the system.
