The Inspection and Localized Construction of the Legal Protection System for Inheritors of Intangible Cultural Heritage in China
The protection of inheritors of intangible cultural heritage is one of key measures to inherit and protect fine traditional Chinese culture.But in reality,there are no inheritors for some intan-gible cultural heritage,and there are other issues that need to be addressed,including the discontinuity risk of inheritors,lack of awareness of protecting independent brands among inheritors,weak ability of secondary creation for inheritors of intangible cultural heritage,as well as lack of distinctive protection mechanisms.In addition,there is lack of rational construction for the existing system to identify represen-tative inheritors;the inheritors find it difficult to gain protection of the intellectual property right;there is limited space for inheritors to share benefits,and the current laws are insufficient to protect the inheritors.These all highlight the shortcomings of the existing legal system for the protection of inheritors.Based on the practical operation of the legal protection system for inheritors of intangible cultural heritage in China,it is imperative to establish a legal system to protect inheritors of intangible cultural heritage that is in line with China's national conditions by clarifying the criteria for identifying representative inheri-tors,breaking through the protection scope of the existing intellectual property right system,exploring a localized benefit sharing system,and improving the localized design for the protection of inheritors.
