Research on Optimizing Local Legislative Procedures in China
Local legislative bodies formulate local laws and regulations in accordance with statutory authority and legal procedures,local legislative procedures play a key role in the development of rule of law at the local level.Sound lawmaking constitutes the reasonable guidance of local legislative proce-dure.Democratic legislation constitutes the source of legitimacy of local legislative procedure.Law-based legislation constitutes the legitimate requirement of local legislative procedure.Local legislative procedures generally consist of the general procedure of local legislation,the local legislative procedures of the cities with subordinate districts,the collaborative regional legislative procedure,as well as the"fast-track"legislative procedure.The basic connotations of optimizing local legislative procedures in-clude the legislation that is people-centered and adheres to the whole-process people's democracy,the lo-cal legislation that is fully committed to the new development philosophy,local laws and regulations that rectify errors in the form of administrative accountability,as well as local laws and regulations that con-tain flexible or supplemental provisions.Local legislative procedures can be improved through such mea-sures as structurally optimizing the local legislative system at the grass-roots level,modernizing local ad-ministrative rules,strengthening local legislative consultation to pool wisdom of the people,and strength-ening the Party's overall leadership over local legislation so as to further promote sound lawmaking,democratic legislation and law-based legislation at the local level.
