The compilation of the Ecological Environment Code has already crossed the stage of academic initiative and become a national task in our country.The establishment of criminal liability is an indispensable and important part of Ecological Environment Code.And the setting of criminal responsibility mainly involves the prescribed manner and specific content of criminal responsibility.In terms of the regulation mode,the Ecological Environment Code should follow the traditional regulation mode of legal liability and set up the referral clause of criminal law in the liability part.In terms of specific content,we should make breakthrough efforts on the systematization and clarification of environmental crimes under the premise of maintaining the unified criminal code model,and introduce environmental restoration measures as a way to bear criminal responsibility,so as to make up for the shortcomings of criminal responsibility in repairing damages.
