Procuratorial Review:the Regulation Mechanism of the Measure of Seal-up,Detainment,or Freezing at Investigation Stage:Taking the Property Right of Suspected Enterprises as the Entry Point
Strengthening the protection of property rights and interests of enterprises involved in criminal process is an important part of improving the protection of property rights of enterprises.In judicial practice,the measure of seal-up,detainment,or freezing is chaotic in the investigation stage,which seriously affects the normal production and operation of enterprises.There are some conceptual reasons for the phenomenon of the abuse of the measures mentioned above,but more important reason is the imperfection of the system.In order to promote the applicable standardizatioin of seal-up,detainment,or freezing measures at the investigation stage,it is necessary to redefine the legal nature of seal-up,detainment,or freezing measures,draw on the experience of the procuratorial review system of arrest and post-arrest detention necessity,and to conduct pre-and post review system of the seal-up,detainment,or freezing measures,so as to improve the criminal judicial protection of citizen property rights and enterprise property rights.
