On Information Obligations of E-commerce Operators:Commentary to Article 50 of The E-Commerce Law
There are many situations of information asymmetry in the field of electronic commerce,which are easy to cause market failure and inefficiency.In this context,Article 50 of The E-commerce Law stipulates the information transparency obligations and procedural setting obligations that e-commerce operators should perform in the process of concluding e-commerce contracts,aiming to eliminate the information asymmetry factors between e-commerce operators and users through special regulations,and prevent or eliminate the representation errors in the process of concluding electronic contracts,so as to promote the equality and efficiency of e-commerce market transactions.According to the provisions of this article,in the process of fulfilling information obligations,e-commerce operators shall,on the one hand,follow the principle of disclosure of specific matters to facilitate users to accurately grasp relevant information,and on the other hand,prevent information overload,so as not to cause excessive understanding burden to users.
