Exploring the Determination of Copyright Nature for Mash-up Videos and Platform Duty of Care
With the continuous advancement of Internet technology and the gradual evolution of business models,creators of mash-up videos are shifting from OGC/PGC(Occupationally-generated Content/Professionally-generated Content)to UGC(User-generated Content).Consequently,conflicts between the original rights holders,mash-up video creators,and information storage space service providers are becoming increasingly pronounced.The subjectivity in defining fair use of works and the complexity surrounding the application of the"notice and takedown"rule make it challenging to determine infringement in judicial practice between creators and information storage space service providers.This article examines typical cases of mash-up video infringement since 2020,delves into the technical and legal complexities inherent in recommended scenarios on short video platforms,and explores the feasibility of establishing a balanced framework of interests among copyright owners,uploaders,and information storage space service providers.
