数据权属确定的困境及其出路

[目的/意义]随着数据纠纷的激增和侵权形式的多样性,有必要明确数据的权属,以维护数据安全和促进数据共享.[方法/过程]通过对数据典型案例和相关理论的研究,发现数据权属确定存在着权利客体范畴难以界定、利益主体众多权利划分困难和简单权利化问题等多重困境.[结果/结论]明确数据权属应当回归到技术层面,通过规制算法进行反向确权,并采取类型化保护模式,创新数据交易范式.
Abstract
[Purpose/Significance]With the proliferation of data disputes and the diversification of infringement forms,it is necessary to clarify the ownership of data to maintain data security and cultivate a market for data elements.[Method/Process]Through the study of typical data cases and related theories,it is found that there are multiple difficulties in determining data ownership,such as difficulty in defining the scope of rights objects,difficulties in dividing rights among many stakeholders,and simplistic rights.[Results/Conclusion]It is clarified that data ownership should return to the technical level,reverse confirmation of rights through regulatory algorithms,and adopt a typed protection model to innovate the paradigm of data transactions.
