信用惩戒在网络空间治理中的适用价值

摘要
[目的/意义]在社会信用体系建设的背景下,信用惩戒成为一项新型社会治理手段.当前,网络空间治理存在的诸多难题,使得传统的司法手段难以破解.信用惩戒引入网络空间治理,在理论、政策和实践方面均具必要性和可行性.[方法/过程]以"必要性-风险-路径构建"论述为逻辑,以网络治理的困境为切入点,对信用惩戒在网络空间中适用问题进行论证.[结果/结论]信用惩戒在网络空间内的适用不违背"一事不再罚"的要求,适用时应当注意遵循禁止不当连结原则和比例原则,将其纳入法治的轨道运行.从适用的完善路径来看,应根据现有政策的指引,发挥惩戒主体间联动和公私合作机制,注重信用惩戒行使的程序正当性,并注重与现有规范的衔接.
Abstract
[Purpose/Significance]Under the background of the construction of social credit system,credit punishment has become a new means of social governance.There are many problems existing in the current cyberspace governance that are difficult to be solved by traditional judicial means.The introduction of credit punishment into cyberspace governance is necessary and feasible in theory,policy and practice.[Method/Process]Based on the logic of"necessity-risk-path construction"and the dilemma of network governance,this paper discusses a series of problems about the application of credit punishment.[Results/Conclusion]The application of credit punishment in cyberspace does not violate the requirement of"no more penalty for one thing",and should pay attention to the principle of prohibiting improper connection and proportionality when applied,so as to bring it into the orbit of rule of law.From the perspective of the applicable improvement path,we should give play to the linkage between disciplinary subjects and public-private cooperation mechanism according to the guidance of existing policies,pay attention to the procedural legitimacy of the exercise of credit punishment and pay attention to the connection with the existing norms.
