[目的/意义]在大数据时代,对于公共视频监控有了新的定义.它不再是曾经被动收集信息的设备,而成为主动识别对象的智能监视系统.[方法/过程]通过文献分析法,重新审视公共视频监控和个人隐私的关系,探究公共视频监控下隐私权的特殊含义.公共视频监控下的个人隐私权保护问题的关键,在于人们在公共场所是否享有隐私权.[结果/结论]对于公共视频监控侵犯个人隐私权的风险分析,探究把握立法原则、完善立法内容等方面保护隐私权的需求.
Abstract
[Purpose/Significance]In the era of big data,public video surveillance has a new definition,it is no longer a passive collection of information equipment,but has become an intelligent monitoring system that actively identifies objects.[Method/Process]Through literature analysis,the relationship between public video surveillance and personal privacy is re-examined.Explore the special meaning of privacy under public video surveillance.The key to the protection of personal privacy under public video surveillance lies in whether people enjoy privacy in public places.[Results/Conclusion]This paper analyzes the risk of public video surveillance infringing on personal privacy,and explores the need to protect privacy by grasping legislative principles and improving legislative content.
