摘要
[目的/意义]在总体国家安全视角下,探讨跨境网络电子数据安全治理的必要性,以应对日趋严重的跨境网络犯罪所带来的威胁,维护国家安全,保障社会经济稳定和人民利益.[方法/过程]围绕着跨境网络电子数据与国家安全的关系,针对电子数据的特征,分析跨境电子数据安全治理在打击跨境网络赌博犯罪中的作用和价值.[结果/结论]跨境网络电子数据的流动,促进了全球数字经济发展,但是也带来了网络安全、数据主权和个人隐私安全等挑战.针对我国当前跨境网络电子数据安全治理面临的现实困境,需要推动国际规则的建立与完善,规范管辖范围,建立多元化数据分级分类机制以及加强国际合作等,以维护数据安全和网络安全.
Abstract
[Purpose/Significance]This paper aims to discuss the necessity of security governance of cross-border network electronic data from the perspective of national security,so as to deal with the increasingly serious threat brought by cross-border cyber crimes,safeguard national security,safeguard social and economic stability and people's interests.[Method/Process]Taking cross-border online gambling crime as an example,focusing on the relationship between cross-border online electronic data and national security,and aiming at the characteristics of electronic data,the role and value of cross-border electronic data security governance in combating cross-border online gambling crime are analyzed.[Results/Conclusion]The cross-border flow of electronic data has promoted the development of the global digital economy,but it has also brought challenges such as network security,data sovereignty and personal privacy security.In view of the current practical difficulties faced by China's current cross-border electronic data security governance,it is necessary to promote the establishment and improvement of international rules,standardize the jurisdiction,establish a diversified data classification mechanism,and strengthen international cooperation to carry out governance,so as to maintain network security and data security.
