[目的/意义]网络化时代,数据安全治理的重要性日益凸显,并成为国家治理体系和治理能力现代化的关键环节.公共数据授权运营作为治理策略的重要部分,对提高治理效率和促进经济发展起着关键作用.在此过程中,实现数据资源的高效利用与隐私保护之间的平衡,是当前面临的一项重要任务.[方法/过程]对公共数据授权运营的实施情况进行分析发现,当前公共数据授权运营面临着隐私判断标准不明确、授权运营边界不明确、隐私侵权行为监管困难等问题,应当通过制定主客观结合的隐私判断标准,构建隐私保护与数据授权运营的平衡机制,以及建立监控隐私侵权行为的全流程监管体系等措施进行规范.[结果/结论]明确的立法指导和技术创新措施能够在保障个人隐私的同时,充分发挥公共数据的经济价值,为数字经济的健康发展提供坚实支撑.
Abstract
[Purpose/Significance]In the era of networking,the importance of data security governance is increasingly prominent,becoming a key link in the modernization of the national governance system and governance capabilities.Public data authorization operation,as a key part of governance strategy,plays a crucial role in improving governance efficiency and promoting economic development.In this process,achieving a balance between efficient use of data resources and privacy protection is an important task we currently face.[Method/Process]After analyzing the implementation of public data authorization operations,it has been found that there are several issues,including unclear standards for privacy judgment,ambiguous boundaries for authorized operations,and difficulties in regulating privacy infringement behaviors.It is necessary to address these issues by establishing comprehensive standards for privacy judgment,balancing privacy protection with data authorization operations,and establishing a comprehensive regulatory system to monitor privacy infringement throughout the entire process.[Results/Conclusion]Clear legislative guidance and technological innovation measures can protect individual privacy while fully exploiting the economic value of public data,providing solid support for the healthy development of the digital economy.
