网络空间安全背景下不干涉原则的适用困境

[目的/意义]近年来,频繁的网络破坏行为给我国的网络空间治理带来了挑战,特别是西方国家不断利用各种场合和方式输出观点,给网络空间全球治理带来了威胁.然而,中国一直倡导建设包容、普惠、有韧劲的数字世界,携手构建网络空间命运共同体.因此,应当明确不干涉原则的具体内涵,推进不干涉原则在网络空间的适用.[方法/过程]基于对文献的梳理和对不干涉原则内涵的深入分析,总结何种网络破坏行动构成对不干涉原则的违反,并从网络空间全球治理视角,提出了我国应对网络破坏行为的治理措施.[结果/结论]通过适当扩大不干涉原则的保护范围,重新审视"胁迫"要件的含义,推动不干涉原则在网络空间中的适用.同时,我国应当积极参与网络空间全球治理,提升国际话语权.
Abstract
[Purpose/Significance]In recent years,frequent cyber sabotage actions have brought challenges to China's cyberspace governance.In particular,Western countries continue to use various occasions and ways to export their views,which brings threats to the global governance of cyberspace.However,China has always advocated building an inclusive,inclusive and resilient digital world and working together to build a community of shared future in cyberspace.Therefore,we should clarify the specific connotation of the principle of non-interference and promote its application in cyberspace.[Method/Process]Based on the literature review and the in-depth analysis of the connotation of the principle of non-interference,this paper summarizes what kind of network destructive actions constitute the violation of the principle of non-interference and puts forward the governance measures to deal with network destructive actions in China from the perspective of global governance in cyberspace.[Results/Conclusion]By appropriately expanding the scope of protection of the principle of non-interference and re-examining the meaning of"coercion",the application of the principle of non-interference in cyberspace is promoted.At the same time,China should actively participate in the global governance of cyberspace and enhance the international discourse power.
