侵犯个人信息网络犯罪的"生命周期式"治理研究

摘要
[目的/意义]在网络时代,侵犯个人信息的行为频发,并呈现出网络黑色产业链的组织形式,极大地危害了人民群众的信息安全和财产安全.[方法/过程]根据信息生命周期理论,我国侵犯公民个人信息网络黑产犯罪具有信息获取期、信息处理期、信息利用期和信息更迭期的生命周期特征,且传统的犯罪治理模式在应对时面临诸多困境.[结果/结论]针对侵犯个人信息网络犯罪的治理,应实行生命周期式的犯罪综合治理模式,从源头预防信息泄露,落实信息流转监督,严厉遏制信息滥用,完善信息侵犯后续处置工作.
Abstract
[Purpose/Significance]In the network era,the behavior of infringing personal information is frequent,and presents the organization form of the network black industrial chain,which greatly endangers the information security and property security of the people.[Method/Process]Based on the information life cycle theory,it can be analyzed that the crime of infringing on personal information network has the life cycle characteristics of information acquisition period,information processing period,information utilization period and information change period,and the traditional crime governance model has many difficulties in dealing with it.[Results/Conclusion]For the management of cybercrimes of personal information infringement,a life-cycle mode of comprehensive crime management should be implemented,information leakage should be prevented from the source,information flow supervision should be implemented,information abuse should be strictly restrained,and follow-up treatment of information infringement should be improved.
