[目的/意义]在网络空间环境日益复杂,算法不断"黑箱"化的背景下,探析网络发展中个人信息保护存在的风险问题,对于我国公民个人信息刑法有效治理和保护领域稳定发展,具有理论和现实意义.[方法/过程]通过对算法"黑箱"概念的界定、个人信息安全动态生命周期的风险分析,指出网络空间安全治理中个人信息保护的困境,并运用文献和比较分析方法,针对性地提出应对建议.[结果/结论]在个人信息刑法保护框架建设中,明确非法收集的犯罪类型,增设非法使用个人信息条款,完善刑法与前置法的衔接.
Abstract
[Purpose/Significance]In the context of the increasing"black box"of algorithms,analyzing the risk problems of personal information protection under the vision of algorithms is of theoretical and practical significance for the effective governance of the criminal law of personal information of citizens in China and the overall stability of the protection field.[Method/Process]By defining the concept of algorithmic"black box"and analyzing the risk of the dynamic life cycle of personal information,we point out the dilemma of personal information protection under the vision of"black box",and put forward the corresponding suggestions for improvement by applying the methods of literature and comparative analysis.[Results/Conclusion]In the construction of the criminal law protection framework for personal information,the types of crimes of illegal collection are clarified,provisions on illegal use of personal information are added,and the connection between the criminal law and the preceding law is improved.
