摘要
[目的/意义]网络是信息化社会的重要基础,网络空间是国家安全和经济社会发展的关键领域,事关国家安全与国家发展战略.数字时代下网络攻击事件频发,为网络空间国际治理带来新的挑战.自卫权作为网络主权的主要内容,对网络攻击的预防和规制具有重大意义.[方法/过程]基于《塔林手册2.0》中自卫权适用网络攻击的具体规则,以各国立法实践为考察对象,研究自卫权对网络空间治理的规范路径.[结果/结论]为了贯彻总体国家安全观,理应向国际社会表达中国立场,积极参与推动网络空间国际治理规则制定,巩固网络空间中的话语权,推进数字法治轨道上国家综合治理能力的现代化.
Abstract
[Purpose/Significance]The network is an important foundation of the information society,and cyberspace is a key area of national security and economic and social development,and a major strategic issue concerning national security and national development.The frequent occurrence of a large number of cyberattacks in the digital age has brought new challenges to the international governance of cyberspace.The right to self-defense,as a major element of cyber sovereignty,is of great significance to the prevention and regulation of cyber attacks.[Method/Process]Based on the specific rules of applying the right of self-defense to cyberattacks in the Tallinn Manual 2.0,we study the normative path of the right of self-defense to the governance of cyberspace by examining the legislative practices of various countries.[Results/Conclusion]In order to implement the overall national security concept,it is appropriate to express our position to the international community,actively participate in promoting the formulation of rules for the international governance of cyberspace,consolidate the right to speak in cyberspace,and promote the modernization of the country's comprehensive governance capacity on the track of the rule of law in the digital world.
