摘要
[目的/意义]电子取证已经成为侦查网络诈骗犯罪的重要手段,研究电子取证的合理性、有效性,提高电子证据的权威性与信服力,严格规范电子证据的搜查、鉴定与保全等,提高我国网诈犯罪的侦破实效,以维护网络空间秩序与安全.[方法/过程]通过分析网络诈骗与电子证据的特点,深挖网络诈骗中有关电子取证、存证等问题,坚持总体国家安全观,从侦查主体、侦查程序和侦查内容等方面出发,构建完整、有效和有力的电子取证体系.[结果/结论]在我国网诈案的侦查工作中,电子证据的发现、鉴定和保全等与案件的侦查息息相关,不断挖掘电子证据的效能、规范与技术,进一步提高网络数据治理与安全保障水平.
Abstract
[Purpose/Significance]Electronic forensics has become an important means of investigating network fraud crimes,research on the rationality and effectiveness of electronic forensics,improve the authority and credibility of the electronic fight,strictly regulate the search,identification and preservation of electronic evidence,etc.,to improve the effectiveness of China's network fraud crime detection,in order to maintain the order and security of cyberspace.[Method/Process]By analyzing the characteristics of the current network fraud and electronic evidence,digging deeper into the problems related to electronic forensics and depositing of evidence in network fraud,adhering to the overall concept of national security,and constructing a complete,effective and powerful electronic forensics system from the aspects of the main body of the investigation,the investigation procedure and the content of the investigation.[Results/Conclusion]In the investigation of network fraud crime cases in China,the discovery,identification and preservation of electronic evidence is closely related to the investigation of the case,and the effectiveness,standardization and technology of electronic evidence are constantly being explored to further improve the level of network data governance and security.
