摘要

[目的/意义]随着科技的发展和网络技术的进步,我国人脸识别技术蓬勃发展,前景一片光明.人脸识别技术为各行各业提供便利的同时,应降低财产、隐私、知识产权等侵权风险.[方法/过程]从国内外现状进行梳理,当前我国人脸识别技术侵权风险缺乏合理的法律规制措施,人脸信息保护的法律规定模糊,政府治理力度不够.结合存在的困境,提出解决措施,以期保护用户的合法权益.[结果/结论]为了确保人脸识别信息保护模式与我国的实际情况相匹配,应积极借鉴欧美国家在隐私保护方面的成熟经验.通过增设惩罚性赔偿条款、完善人脸识别技术的法律救济、提高政府监管水平等措施,在新兴技术发展中保障信息安全、网络安全、降低数据安全侵权风险,从而实现总体国家安全观的要求.

Abstract

[Purpose/Significance]With the development of science and technology and the progress of network technology,China's face recognition technology is booming,and the future is bright.In order to make face recognition technology provide convenience for all walks of life while reducing the risk of infringement of property,privacy,intellectual property rights,etc.[Method/Process]Based on the current situation at home and abroad,this paper analyzes the current lack of reasonable legal regulatory measures for the infringement risk of face recognition technology in China,the vague legal provisions on the protection of face information,and the lack of government governance.[Results/Conclusion]In order to ensure that the protection mode of facial recognition information matches the actual situation in China,we should actively learn from the mature experience of European and American countries in privacy protection.By adding punitive damages clauses,improving legal remedies for facial recognition technology,and improving the level of government supervision,we can ensure information security and network security in the development of emerging technologies,and reduce the risk of data security infringement,so as to achieve the requirements of the overall national security concept.
