网络空间下我国数据安全治理范式选择
Selection of data security governance paradigm in China's cyberspace

摘要
[目的/意义]数字经济时代下,数据蕴含着丰富的经济与战略价值,但是也需结合总体国家安全观进行安全性开发、利用.明确和优化我国数据安全治理范式刻不容缓,可以进一步优化我国数据安全治理体系、平衡多元主体利益、促进数据产业健康、持续发展.[方法/过程]运用文献研究法、比较研究法和案例分析法,考察域外数据安全治理与我国司法审判实践.[结果/结论]数据安全治理具有安全性与利用性并存、多主体利益诉求差别化、动态化与系统化兼顾等特征.我国应摒弃形式主义的赋权范式,适用基于具体应用场景的行为规制范式,以合同法、侵权法、反不正当竞争法和公法路径,最大限度地实现数据安全与数据利用之间的平衡.
Abstract
[Purpose/Significance]In the era of the digital economy,data carries abundant economic and strategic value.However,it requires secure development and utilization in conjunction with the overall national security perspective.Therefore,it is urgent to clarify and optimize China's data security governance paradigm.This can further enhance the data security governance system,balance the interests of multiple entities,and promote the healthy and sustainable development of the data industry.[Method/Process]By using literature research method,comparative research method and case analysis method,this paper examines extraterritorial data security governance and judicial practice in China.[Results/Conclusion]Data security governance has the characteristics of coexistence of security and utilization,differentiation of multi-subject interest demands,dynamic and systematic consideration,etc.Therefore,China should abandon the formalistic empowerment paradigm and apply the behavioral regulation paradigm based on specific application scenarios.To maximize the balance between data security and data utilization through contract law,tort law,anti-unfair competition law and public law.
