摘要

[目的/意义]在信息技术与公民网络安全意识逐渐提升的背景下,信息安全成为公民日益关注的焦点.然而,大数据侦查在利用个人信息侦破案件的同时,对个人信息安全造成诸多挑战.因此,应当探寻解决路径,促进大数据侦查规范化和法治化,切实维护个人信息安全.[方法/过程]在讨论大数据侦查中个人信息新特点的基础上,剖析个人信息安全在大数据侦查中的困境并提出解决方案.[结果/结论]个人信息安全在大数据侦查中存在着遭受无形侵害、信息易被过分采集、信息泄露风险加剧等困境,应当通过采取信息分级与侦查分类、搭建权利救济体系、改进大数据侦查技术、完善信息共享模式等措施予以破解.

Abstract

[Purpose/Significance]In the context of information technology and increased awareness of cybersecurity among citizens,information security has become a growing concern for citizens.However,while big data investigation utilizes personal information to solve cases,it poses many challenges to the security of personal information.Therefore,the solution paths should be explored,so as to realize the standardization of the rule of law for the big data investigation and to effectively safeguard the security of personal information.[Method/Process]On the basis of discussing the new features of personal information in big data investigation,the dilemma of personal information security should be analyzed and solutions should be proposed.[Results/Conclusion]The dilemmas of personal information security in big data investigation mainly include:invisible infringement of information security,excessive collection of information,increased risk of information leakage,etc.,which should be resolved through measures such as information gradation and investigation classification,establishment of a rights relief system,improvement of big data investigation technology,and improvement of information-sharing models.
