论自动投案的时间限制标准认定

摘要
符合自动投案的时间限制是自动投案成立的前提和关键,但是目前理论界对于自动投案时间的限制并没有形成一个统一的标准,部分满足法律规定的行为却不符合自动投案的实质,有必要确立一个自动投案时限的实质性标准来填补理论上的空缺.当前,法律规定中的归案标准无法穷尽所有情形,也忽视了抓捕行为对自由意志的影响,致使自动投案的认定存在诸多争议.通过引入控制的概念对归案标准进行明确,以司法机关宣告实施控制作为时限的补充,提出自动投案的时间限制标准.
Abstract
Meeting the time limit of automatic surrender is the prerequisite and key to the establishment of automatic surrender,but at present,the academic circle has not formed a unified standard for the time limit of automatic surren-der.Some behaviors that meet legal requirements do not meet the essence of automatic surrender.It is necessary to establish a substantive standard for the time limit of automatic surrender to fill the theoretical gap.At present,the le-gal standards for surrender cannot cover all situations,and ignore the impact of arrest on free will,leading to many controversies in the determination of automatic surrender.This paper introduces the concept of control to clarify the criteria for filing a case,with judicial authorities declaring the implementation of control as a supplement to the time limit,and proposes a time limit standard for automatic surrender.
