Review and Reflection on the Local Legislation on the Protection of the World Cultural Heritage in China
In order to normalize and strengthen the protection and management of world cultural heritage,an increasing number of local governments have formulated special regulations for world cultural heritage within their jurisdictions.However,due to the limited legislative authority,the rigidity of the relevant rules in upper-level national laws and regulations,as well as legislative time limits and limited supporting resources,there are some problems such as conflict of legal concepts,duplication of legislation,conflicts of rules with the higher-level law,and violation of the legislative authority in the local legislation concerning China's world cultural heritage,which means the construction of the legal system of world cultural heritage is insufficient.Solving those problems not only requires the improvement of local legislative concepts and technologies,and the strengthening of coordinated legislation,but also requires the formulation of high-level legislation for the unified protection and management of world heritage,as well as the further improvement of China's cultural heritage legal system.
