Reform Path of Compliance Governance of Cross-border Flow of Commercial Data in China
In the context of the globalization of data economy,cross-border data transmission is becoming increasingly frequent.While the cross-border flow of business data promotes economic growth,it also raises concerns about personal data security and national security in different countries.The rich connotation of business data,coupled with the uncertainty of external environment,determines the necessity of compliance governance of cross-border business data flow.In response to the current legislative decentralization and difficulties in corporate compliance in the governance of cross-border commercial data flow,below measures should be taken:perfect the legal system of commercial data compliance to provide clear guidance for cross-border commercial data flow compliance;establish a specialized and independent data cross-border supervision agency,and build a comprehensive governance system for cross-border flow of commercial data,to provide practical guarantees for the supervision of cross-border commercial data flow;actively reach bilateral or multilateral cooperation with major countries and regions around the world,promote the formation of unified global data governance standards,to reduce the pressure of two-way compliance for enterprises.
