新质生产力的蓬勃发展在提升经济效益的同时,也对传统的治理机制提出了挑战.法治作为平衡创新与风险的制度天平,以特殊规则规范和引领创新事业.法治涵摄新质生产力的发展进程,能有效推动共同富裕、鼓励开拓创新、矫正不公平的竞争格局.法治坚守新质生产力发展权这一底层逻辑,实现对企业、研发人员和国家自主创新的正向激励.明确的规则清单、向善的价值理念和社会本位价值立场,为防范化解发展新质生产力可能引发的系统性风险提供了可行方案.
Abstract
The vigorous development of new quality productive forces not only enhances economic efficiency,but also challenges the traditional governance mechanism.The rule of law,as the institutional balance between innovation and risk,regulates and leads the cause of innovation with special rules.The rule of law covers the development process of the new quality productive forces,promotes common prosperity,encourages innovation and corrects the unfair competition pattern.The rule of law adheres to the underlying logic of the right to development of new quality productive forces,and realizes positive incentives for enterprises,researchers and national independent innovation.A clear list of rules,goodwill values and a social-based value stance provide viable options for preventing systemic risks arising from new quality productivity forces.
