Research on Cross-regional Centralized Jurisdiction of Environmental Cases in the Yangtze River Basin
The traditional environmental judicial jurisdiction model based on administrative divisions contradicts the ecological,holistic,and systematic nature of environmental protection in the Yangtze River basin,and centralized jurisdiction of environmental cases in the basin can serve as a key path to solving environmental governance problems.Through empirical analysis,it has been found that the specific practice of centralized jurisdiction across administrative divisions in various provinces involved in the Yangtze River basin currently faces constraints such as low degree of administrative division separation,insufficient legal basis,and poor connection of environmental judicial specialized agencies.It is necessary to establish a comprehensive environmental governance concept based on the overall and systematic theories followed by watershed governance,and to establish the geographical unit of the Yangtze River basin as the foundation,to ensure the substantive effectiveness of centralized jurisdiction;Establish and improve the supply of legal norms for the jurisdiction of environmental resource cases across river basins and administrative divisions,and provide unified standards for judicial practice to follow;Adhere to the specialized reform of environmental justice,develop and improve specialized jurisdiction based on the framework of the Yangtze River Ecological Environment Court,in order to eliminate the obstacles of administrative divisions to watershed environmental justice,and enhance the standardization and effectiveness of watershed centralized jurisdiction.
