Realistic Predicament and Perfection of Prosecutorial Supervision over Com-munity Correction of Minors
At present,there are some problems in the procuratorial supervision of juvenile community correc-tion in China,such as the unclear subject of procuratorial organ,the emphasis of procuratorial supervision on post-supervision,the one-sidedness of procuratorial content,and the lack of rigidity of supervision means,which are not conducive to the high-quality development of juvenile community correction.It is important to improve the procuratorial supervision system of juvenile community correction from two aspects of system and concept.At the institutional level,one should improve the legal norms of the procuratorial supervision of com-munity corrections,establish the procuratorial system of"dispatch+tour",expand the post-supervision into the whole-process supervision,and effectively protect the legal rights of the minor community correction ob-jects.At the conceptual level,the procuratorial organ should clarify the functional orientation of the procurato-rial supervision of juvenile community correction,lead high-quality procuratorial supervision with the concept of precise supervision,carry out supervision work guided by the principle of the most beneficial to minors,es-tablish a systematic concept and improve the effectiveness of community correction.
