摘要
"私生饭"对明星追逐的疯狂程度远远超越了正常粉丝的行为边界,他们的行为严重侵犯他人隐私,扰乱公共秩序,影响青少年正确价值观的形成,具有民事、行政以及刑事上的违法性.我国对"私生饭"行为的法律规制不足,包括缺乏法定"私生饭"行为的认定,相关案件取证难、审理时间长,互联网监管存在缺陷,家庭和学校教育存在缺失等.我国需约束规制"私生饭"行为,即在法律层面完善相关法律以及诉讼程序,加强互联网的监管;在道德层面强化未成年人家庭与学校教育.
Abstract
The prosperity of the entertainment industry has made star-chasing a fashion for some young people,and then a group called"Sasaeng"come into being,its crazy degree of star chasing goes far beyond the normal fan behavior boundary.The behavior of"Sasaeng"seriously infringes on others'privacy,disturbs public order,affects the formation of teenagers'correct values,and is illegal in civil,administrative and crimi-nal matters.There are difficulties in the legal regulation of"Sasaeng"in China,including the lack of legal identification of"Sasaeng",the difficulty of obtaining evidence in related cases,the long trial time,the defects of Internet supervision,and the deficiencies of family and school education.China needs to restrict and regu-late the illegal behavior of"Sasaeng",that is,improve the relevant laws and litigation procedures at the legal level,and strengthen the supervision of the Internet,strengthen the family and school education of minors at the moral level.
