A Study on Global License Rates Jurisdiction of Transnational Standard Essen-tial Patents Proceedings
The lack of a globally harmonized proceeding law has led to the normalization of cross-border par-allel proceedings,making it difficult to enforce global license rates for standard essential patents(SEPs).In the case of Unwired Planet v.Huawei,the British court took the initiative to adjudicate global license rates for SEPs for the first time,which triggered many countries to follow suit and caused the competition of national standard and necessary patent jurisdiction.With the surge in the value of SEPs,China needs to pay more atten-tion to them in terms of policy and justice,establish the global license rate litigation jurisdiction of SEPs and seek a way to resolve the conflict of rates adjudications.
