On Inheritance of Properties of Families Without Heirs in the Song Dynasty Based on Ming Gong Shu Pan Qing Ming Ji
On the basis of inheriting the achievements of previous generations,the inheritance law of the family in Song Dynasty was further developed,and the property inheritance system of the family in Song dynasty tended to be perfect and strict.According to the case analysis of Ming Gong Shu Pan Qing Ming Ji,we can see that wid-ows,daughters and stepson enjoy different inheritance rights according to their different identities.A widowhood who remarries loses the right to inherit the property of her deceased husband,except for a dowry;A widow who does not remarry enjoys incomplete inheritance rights.The property inheritance rights of the stepson are affected by status,the inheritance rights of the"Liji"stepson are equal to the biological children,and the inheritance rights of the"Mingji"stepson are limited by proportion and amount,and are further restricted when there is a daugh-ter.The inheritance rights of virgins,converted daughters,and married women decrease in turn,and are further reduced when there is a"Mingji"stepchild.
