Research on Legal Protection of Employment Rights for Persons with Disabilities from the Perspective of Feasible Ability:A Case Study Based on Jing'an County,Yichun City,Jiangxi Province
To this day,with the development of social productivity driving the improvement of people's living standards,the disabled group is no longer unable to guarantee basic survival like in the past.However,the em-ployment concept of the disabled group is incorrect,and the employment dilemma of low competitiveness still ex-ists,which leads to many disabled people finding it difficult to rely on themselves even if they have normal work abilities.Although the Constitution of our country does not explicitly stipulate the labor rights and employment se-curity of people with disabilities,it also clarifies that citizens have the right and obligation to work.The protection of the labor and employment rights of the disabled group is an important part of China's human rights protection,and also an important practice of the basic principle of respecting and safeguarding human rights in the Constitu-tion.This article studies the overall employment situation of the disabled population in Jing'an County,applies Amartya Sen's feasible ability theory,and provides a detailed understanding of the composition and employment situation of the disabled population in the county.It analyzes the reasons for the problems and proposes counter-measures.
