In the contemporary Chinese judicial context,the courts have accumulated rich judicial practice experience around the case judgment,and generated a judicial advisory system with Chinese characteristics.As a judicial system or judicial practice,it has its own effective conditions,ways and functional boundaries.The judicial advisory system is rooted in the socialist legal system and judicial system with Chinese characteristics,contains the unique gene and texture of China's judicial system,and is an important part of the operation mechanism of judicial power in contemporary China.The judicial advisory system shows a kind of bottom-up experience exploration and quiet organizational transformation,and always coexists,games and struggles with the top-down system construction.In order to give full play to the positive system function of judicial advisory system,it is necessary to type its organizational form,sum up and extract its basic characteristics,explore its formation,evolution mechanism and law,and reflect on the causes of its variation,and finally deepen its system reform.
