The Analysis of Optimizing the Clearing-House Mechanism of BBNJ Agreement on the Legal Perspective of Global Marine Governance
The construction of Clearing-House Mechanism(CHM)is an innovative means of global governance in the area of the conservation and sustainable use of marine biodiversity in areas beyond national jurisdiction,which can be used in regulation of international law for better marine resource integration and sharing of the high seas.There are many deficiencies on the setting philosophy,the number of CHM,the functions,the regulatory agency and the mode of operation of the CHM under discussion of international conferences.CHM of BBNJ Agreement should select the essence of other CHMs which are used by other international instruments in order to provide suggestions for improving CHM of BBNJ Agreement.The methods of optimizing the CHM of BBNJ include bringing the special circumstance of Small Island Developing States into legal regulation,establishing three-stage sharing network of global,regional and national level,specifying and refining the specific and legal functions,building a joint-managed body composed of secretariat and other existing body and setting up a network platform in which experts and practitioners can interact with each other.
