共同富裕的权利向度、法治意蕴与法治保障

党的二十大指出,要扎实推进共同富裕.从法学视角来看,共同富裕具有法治文明意义.作为治国之策的共同富裕古已有之,从传统富民观,到"平均地权"说,再到新时代共同富裕,共同富裕的理论伴随着权利保障理念而萌生、明晰与丰富.以法思想言之,共同富裕与以人民为中心的习近平法治思想相统一;以法制度言之,它与宪法的社会主义法治原则的核心内涵相契合;以法哲学言之,它的法权要求与中国式法治现代化相呼应,推进共同富裕将丰富中国式法治现代化的价值内蕴.与此同时,中国式法治现代化是推进新时代共同富裕的重要保障,为此,应做好与脱贫攻坚法治建设的衔接,构建更为全面的分配正义制度体系,着力强化法律制度的贯彻实施.
The Dimension of Rights,Rule of Law Implications and Rule of Law Guarantee for Common Prosperity
The 20th National Congress of the Communist Party of China(CPC)points out that we should promote common prosperity in an all-round way.From a legal perspective,common prosperity is of great significance to the rule of law civilization.As a policy for governing the country,common prosperity has existed since ancient times.From the traditional view of enriching the people,to"average land rights",and then to common prosperity in the new era,the theory of common prosperity has been born,clarified and enriched along with the concept of guaranteeing rights.In terms of legal thought,common prosperity is consistent with the people-centered thought of Xi Jinping on the rule of law;in terms of legal system,it is consistent with the core connotation of the socialist principle of the Constitution;in terms of legal philosophy,its requirement of legal power corresponds to Chinese rule of law modernization,and promoting common prosperity will enrich the value connotation of Chinese rule of law modernization.At the same time,Chinese rule of law modernization is an important guarantee for promoting common prosperity in the new era.Therefore,we should do a good job in the legal connection with poverty alleviation,build a more comprehensive justice system for distribution,and strengthen the implementation of legal systems.
